Review

Please be aware: certain cultural goods belonging to the cultural heritage of this state are included in object categories of the so called Red List for Southeast European Cultural Objects at risk of the particularly endangered cultural heritage by the International Council of Museums ICOM.

National legal bases

EU regulations
The licence for the export of cultural goods from the European customs territory is subject to Council Regulation (EC) No. 116/2009 of 18 December 2008 on the export of cultural goods (OJ L 39, 10.2.2009, p. 1). Exports to the internal market, however, are subject to national regulations, which may differ from the Council regulation with respect to the value and age thresholds of the categories of the protected cultural property.

The multilingual UNESCO Database of National Cultural Heritage Laws provides access to the relevant national legal bases. Another source of information on national cultural asset protection laws is the Sharing Electronic Resources and Laws On Crime (SHERLOC) of the United Nations Office on Drugs and Crime (UNODC).

This State Party to the UNESCO Convention of 14 November 1970 is also a State Party to the 1995 UNIDROIT Convention on Stolen or Illegaly Exported Cultural Objects, which entered into force on 1 July 1998. The national legal bases are therefore also partially provided by the WIPO database.

Definition of cultural property

According to Art. 1 (partially amended by Law 314/2004), Romanian cultural heritage comprises various categories of cultural objects. Accordingly, the list of objects covered is not exhaustive, but exemplary.

According to Art. 3 (1), archaeological and historical-documentary goods of exceptional value, such as:
a) products of archaeological exploration and excavations conducted on land
and under water, tools, pottery, inscriptions, coins, seals, , jewellery,
items of cloths or harness, weapons, funerary remains;
b) items resulting from the dismemberment of historical monuments;
c) items relating to the political, economic, social, military, religious,
scientific, artistic, sportive history;
d) manuscripts, incunabula, rare books, old books, books of bibliographic
value;
e) documents and printed works of social significance: archives documents,
maps and other cartographic materials;
f) objects of memoirs value;
g) items and documents of numismatic, philatelic, heraldic value: coins,
medals, decorations, badges, registered designs, stamps, flags and
banners;
h) epigraphic items;
i) photographs, photographic negatives, cinematographic films, sound
recordings;
j) musical instruments;
k) military uniforms and accessories;
l) items of technical value;
m) other goods relating to this category

According to Art. 3 (2), items of artistic interest, of exceptional value, such as:
a) works of plastic arts: paintings and drawings, sculptures, engravings,
photographs and others;
b) works of applied art in such materials as glass, ceramics, metal, wood,
textile and other materials, adornments;
c) cult objects: icons, embroideries, gold jewellery, items of furniture and
others;
d) projects and prototypes of design;
e) original materials of animation, documentary and artistic movies;
e1) public monuments, outdoor exposed artistic items;
f) other goods relating to this category. 

According to Art. 3 (3) items at ethnographic interest, of exceptional value, such as:
a) household and domestic appliances and tools;
b) items of furniture;
c) pottery;
d) textile objects, clothing items, leather items;
e) other items of metal, wood, bone, rock, glass;
f) cult objects;
g) adornments;
h) ensembles of ethnographic items;
h1) traditional buildings that are not conserved in situ or items resulting
from the dismemberment of this;
i) other goods relating to this category.


According to Art. 3 (4) goods of scientific interest, of exceptional value, such as:
a) rare zoological, botanical, mineralogy and anatomy specimens and
collections;
b) game trophies;
c) other goods relating to this category.


According to Art. 3 (5) goods of technical interest, of exceptional value, such as:
a) unique technical creations;
b) rarities, irrespective of mark;
c) prototypes of current machines, appliances and creation tools;
d) technical creations of memorial value;
e) realisations of popular art;
f) stencils of compact-disk, of CD-ROM, of DVD and others;
g) other goods relating to this category

Export ban

The permanent export of cultural goods requires an export certificate, pursuant to Art. 37 (2).

Art. 37
(1) Transferring abroad movable cultural objects constitutes an operation of export,
which can be temporary or permanent.
(2) Permanent or temporary export of classified or unclassified movable cultural
goods can only be performed on the basis of an export certificate.
(3) The export certificate will be issued by the county offices for culture and
national culture heritage, in compliance with the present law.
(4) The temporary export certificate for movable cultural objects classified as
thesaurus can only be performed on the basis of the export certificate.
(5) Transferring abroad, by any way, movable cultural objects for which the
temporary or permanent export certificate, issued according to the law,
represents illegal export.

Goods classified as national treasures (Thesaurus) may only be exported temporarily and require a corresponding export certificate, Art. 37 (4). Art. 38 specifies the following:

  • Classified movable cultural goods, held in public property, are only temporary
    exported and only for organising expositions abroad, for laboratory
    investigations, restoration or expertise purposes.
  • Movable cultural goods classified as thesaurus, held in private property, can be
    exported only temporary. Movable cultural property in the possession of the state or administrative-territorial units, may be removed from the country only temporarily and only for the organisation of exhibitions abroad, laboratory examinations, restoration or expertise (Art. 38 para. 1).

Cultural property classified as a national treasure in the possession of natural persons or legal entities under private law, may also only be exported temporarily. In special exceptional cases, due to historical, scientific or cultural interests, a classified cultural property owned by natural or legal persons under private law may be exported, provided that there is an exchange with properties of comparable value and importance for the museum heritage in Romania (Art. 40, para. 1).

Sanctions

Taking a good out of the territory of a state without an export certificate represents illegal export and will be punished with prison for 2 year to 7 years in prison, persuant Art. 69 (1).

The total loss of a classified movable cultural object will be punished with prison for 3 to 10 years, Art. 69 (3).

Any permanent export of classified movable objects, regardless of bearer of the property right will be punished with prison for 3 to 10 years, and the objects shall be confiscated and transferred to specialized public institutions, with the approval of the National Commission for Museums and Collections, Art. 70.

Accordin to Art. 70-1 (1), the import of movable cultural goods, which are part of the cultural heritage of a foreign state, according to the legal dispositions of that state, and that were illegally exported, shall be punished with prison from 3 to 10 years.

Article 69:
(1) Removing an object from the territory of a state without an export certificate represents illegal export and shall be punished with prison for 2 year to 7 years.
(2) Movable cultural objects subject to illegal export shall be confiscated and transferred to specialized public institutions, with the approval of the National Commission for Museums and Collections.
(3) If the perpetration stated at paragraph (1) resulted in the total loss of a classified movable cultural object, the perpetrator(s) shall be punished with prison for 3 to 10 year
(4) Any tentative shall be punished.

Article 70:
Any permanent export of classified movable objects, regardless of bearer of the property right shall be punished with prison for 3 to 10, and the objects shall be confiscated and transferred to specialized public institutions, with the approval of the National Commission for Museums and Collections.

Article 70-1:
(1) Bringing into Romanian’s state territory, as well as holding, commercializing, organizing shows or any operation regarding the circulation of movable cultural objects or goods resulted from the dismemberment of immovable cultural items, which are part of the cultural heritage of a foreign state, according to the legal dispositions of that state, and that were illegally exported, shall be punished with prison from 3 to 10 years.
(2) The objects stated at paragraph (1) are confiscated and shall be transferred to specialized institutions, in order to be conserved and returned to the state whose national cultural heritage they belong to. 
(3) In the case of the infraction stated at paragraph (1), the criminal pursue is done by the prosecutor.
(3)   Any tentative shall be punished.

Authorities responsible for issuing export permits

There are 42 authorities subordinated to the Romanian Ministry of Culture, responsible for issuing exportcertificates: The Directorate for Culture of the Municipality of Bucharest and 41 County Directorates for Culture.

For the applications for temporary or permanent export of an unclassified movable cultural object, the delay stipulated is 30 days.
